• • sukumar mondal Corruption in Income Tax Department : Nexus with Transfer and Posting : Lack of transparent transfer and posting policy Every Establishment tries to get maximum from the manpower at their disposal by suitable posting of right person in the right position only exception is the income Tax Department which is the most important organ of the Government of India which collects revenue for the country. If we look in to the All India Transfer Policy 2008 ( Income Tax) we will find that it discusses about interstate transfer guideline of the IRS Officers leaving the posting of IRS Officers, under Chief Commissioners of Income Tax Charges( CCITs) at the mercy of the Local Placement Committees (LPCs). No criteria for selecting any Officers for any post has been prescribed which results in arbitrary action of the LPC, resulting mostly sycophants,corrupts,and inefficient wrong men who can manage their bosses getting posting in sensitive and core area viz. –Corporate assessment charges, post search and seizure assessment in Central Circle charges , investigation wings and others in non core areas . Each and every section has its importance but there should be inbuilt system which guarantees that efficient, honest and pro revenue officers with proven track records are posted in core areas as above for higher and efficient tax administration and collection of Revenue. In practice we find no such policy is followed, rather a section of officials are posted in those core area charges repeatedly and others are rotated in non-core areas throughout their whole career without any consideration of his past records of efficient working, honesty, integrity . Myself worked in Income Tax Department since 01-03-1982 upto 31-01-2010, ( the date of my retirement on superannuation ) and never bothered about my transfer and posting. and tried to give my best where ever posted ( mostly non-core areas ) be it TDS, ( my tenure lasted for 4 and half year against regular 2-3 years term) CIB . (These postings are in general perception - punishment posting for undesired element not in toe with Admn. Or Association ) I was promoted as Income Tax Officer in February 1992 ,as Assistant Commissioner in October 2002 and as Deputy commissioner on 01-01-2007. Through my career as Officer since 1992 upto 31-01-2010, I was never posted in those core areas for the reason best known to the Admn. and Association never bothered to think over the injustice, as I was not in their inner circle , More over myself was reluctant for begging my posting . Now I am not in the Department but still feel for many like myself, who suffer silently without raising any voice fearing harassment, ,vigilance transfer to far off places, posting under supervisory officer difficult to please and control , etc. and the Association( ITGOA ) prefers to ignore such cases and more active in getting their men in their desired postings ,places, incollution with Administration(Admn.) While holding the post of President of Income Tax Gazetted Officers’ Association, ( ITGOA) Karnataka and Goa Unit , I seriously thought about the transfer and posting policy followed in the Administration of Chief Commissioner of Income Tax( Classification Control and Appeals ) CCIT(CCA) charges who are the authority for effecting manpower utilisation and transfer and posting of officials within CCIT(CCA) Charges. The injustice as glaring but none protested.During my tenure under CCIT(CCA) Bangalore charge, spaning June 2005 to June 2009 ,I faced 5 five transfers from one non-assessment non-core posting to other But never challenged but wanted to know the policy followed which antagonized the Admn ,result is clear from my posting profile . In CCIT(CCA) Bangalore charge, being an office bearer, we forced the administration to formulate a transparent transfer and posting policy for Income Tax Officers, Group “B” officer and suggested with a model transfer policy for implementation to the Admn, at Bangalore CCIT(CCA) charge.. Inter State transfer among Cadre Controlling CCIT Charges , situated in different states of India ,of Group “A” Officers – Assistant Commissioners and above are controlled by All India Transfer Policy 2005 revised time to time now A I T P =2008 The All India Transfer Policy mainly dealt with transfer of Gr A officers , inter-State /inter CCIT(CCA) Charge only ( Generally each state have one CCIT(CCA) Charge except small states like Goa, Andaman , Sikkim and North East States etc, ) The Policy spelt out terms for transfer from one state (CCIT(CCA) to other but silent about the policy of posting of officers with in the CCIT(CCA) Charges. Clause 4.1 has vested the power with Local Placement Committee ( LPC) consisting with senior most Commissioner under that CCIT(CCA) Charge and other members. But no criteria has been found to be prescribed for adjudging suitability of any Officers in any post, Sensitive, non-sensitive, assessment, non-assessment and purely administrative charges as Headquarters shall be adjudged, has been fixed . The power is vested with the wisdom of the local placement committee. With due respect to the members of the Local Placement Committee it has been observed that no policy is followed and this is the birthplace of nepotism widespread corruption , dissatisfaction among others the deprived class . A section of Officers are posted in cream areas viz. Corporate assessment charges, Central Circle charges( where post search and seizure operation assessments are made )and investigation wings - conducting search and seizure operations depriving a large section of officials which creates lack of incentive and overall despondency among the left out . In response to Petitions under Right to Information Act 2005 , filed to the CPIOs under CCIT(CCA) Kolkata, Bangalore and Chennai Charges requesting for furnishing the policy followed and criteria for selecting any officer for any post , none of the charges could furnish following any transparent policy. It has been intimated that = even the minutes of LPC were not drawn recording the proceeding of selection process of officers before any Transfer and Posting Orders are passed . In effect in Bangalore CCIT(CCA) charges, a section officers are posted in assessment, sensitive charges, investigation wing , repeatedly , even exceeding the term of tenure ( 2-3 years ) as prescribed in the All India Policy. At least one Officer since his promotion as Income Tax Officer has never been posted in any non assessment charges till his promotion as Joint Commissioner of Income Tax recently. Many unfortunate others are posted as Tax Recovery Officer more than once in their service career ( in one case more than 5 years as Tax Recovery charge )while some ere never posted as Tax Recovery Officer through out their whole caree.r. In CCIT(CCA) Kolkata charge the same gloomy picture has been detected and section of officials close to the administration /Association are posted repeatedly in those core areas keeping other far away( myself is an example but not the only one ). Response against RTI application seeking information about policy followed and records: CCIT(CCA) Chennai charge’s response is surprising – No records available. In all three charges no recording of Minutes of the Local Placement Committee was drawn which speak volume of the lack of transparency and nepotism In two separate RTI petitions details of posting of officers in Company Circles, Central Circles and Investigation wing in CCIT(CCA) Kolkata and Bangalore charges were sought which were refused and further second appeal is pending before the Honbl’e Central Information Commission, New Delhi . As I was bold enough to question, my prayer for posting in my home town was turned down, even my transfer to Head office at Ayakar Bhavan, centrally located, easy for commuting with post operation difficulties related to Spinal Chord problems , from my residence, was not considered, though request of many others for change of posting were granted even more than once.The records of proceedings of granting transfer to all other and rejecting my case, asked for through RTI petition was not supplied which is now in appeal before Central Information Commission. The matrix of posting shall expose how a section of officers are rotated in these high profile sensitive charges , having high revenue potential and ….and how a large section is deprived of. During his tenure as the president of ITGOA in response to call from, newly created the Human Resourses Department of the Income Tax Department CBDT, proposal was given regarding Model Transfer and Posting policy with in CCIT(CCA) charges but nothing happened and Ad.Vi of CBDT is playing the lead role sidelining the HRD Salient features of Proposal sent to the CBDT for formulating a Transparent Transfer and Posting policy : 4. Categorization of all the charges under CCIT(CCA) 1. Sensitive Charges a) Investigation Wings, under DIT(Investigation ) b) Central Circles c) Large Tax Payers Unit (LTU) 2. Non-Sensitive charges Category - 1, Assessment Charges a) Corporate Assessment charges b) Big Business house other than Corporate sector c) Film Circle / Doctors Circle /Professional charges etc. d) Other Business wards 2A Non-Sensitive charges Category – II ,Non assessment charges a) DTRTI(Training ), Salary Wards, TDS, DIT (Exemption) Head Quarters, Judicial, Audit, Administration, Vigilance, Prosecution, CIB, ITAT, CPC (Central Processing Unit ) , TP( Transfer Pricing) , Intl Taxn. ( International Taxation ) . Cental Processing Centre (CPC ) etc. 3. I run a small business and now and then my boys would paste some posters around our local area. On 4th August being a Sunday my main person asked me to take out my car to go some distance to paste the Posters. Frankly the way i know the state of affairs of this nation, Four Person on a Black santro after 10pm in night are highly likely to be stopped on police check posts or enquired upon by each and every passing police person, specially if standing by the side on the roads [you have to stop to paste posters]. Anyway as the occupancy of my PG was low i agreed. While going we had to pass a check post but on the other side of the Road and i saw a boy and girl on a bike somewhat pleading. One can fairly presume that one might have his bike paper alright but policemen are smart enought to ask question like where are you coming from, where you work, where you are going or something which will entice a uncomplete answer and hence this pleading that we saw. Anyway, None of my business but thats Corruption Number 1 i saw. 5 Minutes later i parked on road side near a Hospital with many outstation Patients. Poster here gives response and my boys dispersed about pasting them. As i had feared, a Policemen on a Bike Stopped and enquired. I immediately got out of my Car and calmly explained / showed my Posters which were for my business, Gave answers to Where the business is located, who i am, where i stayed etc. Then came my turn. You cannot Paste Poster. Well dont mind that i could see innumerous Posters of every hue and kind pasted all around but the Policeman claimed that i was wrong. Fact is I am. Double Fact is, so is 99.99 Perent of poster ever pasted any where in the WHOLE OF INDIA. I cannot imagine Municipal Department taking a Tax and letting anyone paste Posters in any city, but i seriously cannot enquire about each and every Laws and bylaws of this country and if other persons can normally / visible do a activity which is not objectionable, inflammatory, hurting religious sentiments, possible create animosity or Law and Order Problems, My exlaining that the Posters are of a PG Business and what my identity was, should have been enough to satisfy a policemen, had he been following his duty. Corruption Number 2 - What if he is out for Collections, my possessing a Car made me a nice "Bakra". Mere boys on foot or cycles pasting Posters would not have had enticed his attention. Well things followed, Policemen could use any TONE, but "We the People of INDIA" have to address the lowest ranked Policemen as "SIR" with DEEP pleading, pity, guilt and sorry in our voices..... You get the Idea. But not me. I am extremely bored to having bow my head each and every time i have to face a Sundry Police Person . Every one knows even if there is a Challan / fine for illegally pasting a Poster it might be for 50 or 100 Rupees. The Policemen might not have a Challan Book or even knows the Sections. But Every INDIAN and POLICEMEN know that confrontation with a policemen will not result in you being Booked for the "matter" in question, it would be for something entirely different like a Policemen would report "we got a report that someone had a fight / eve-teased and had run on a black car and we stopped and booked them" or definately something far worse even discovery of weapons or contrabands from my car. The List of Possibilities are endless. But my Patience is Not. I am Angry for being treated like a lowly Animal by Authorities be it Legal, Administrative or Police. Every one reading this post will relate to this post but will not have the Spine to actually start doing anything. If the Same things would happen they would request or pay there way out and think of themselves as Lucky or better still Smart. I have Snapped. [Cannot detail here the unplesantrise / treats that followed] Anyway my boys returned and one of them "Personally" knew the Policemen and he pleaded and said Sorry on my behalf and i was just sitting in my car, humiliated, so very frustrated at the Corrupt System. Had i actually being booked it would be the Policemen who could have easily Fulfilled the Paperwork and Satisfied the Legal Court System for my being at Fault, all this on their mere whims, fancies and EGO. Anyways, we moved on but as the tempo of Pasting Poster was lost, we just stopped to have Icecream to Chill and returned back. We passed the CheckPost which was on our side now on the return and could see a "Out of Delhi" Registration Vehcile being stopped and Occupants "Harrased". Corruption Number 3. Further ahead there was a Goods Laden Truck being Stopped by a PCR Van, For God sake, PCR [Police Control Room] dont even have Challan Books or Authority to act on there Own unless there is a Dialed 100 Complaint forwarded to them or some citizen approaches them with a Complaint or there is a Visible Act of Law and Order Disturbance. Corruption Number 4 of Goods Laden Truck harrased and intimated to shell some money. 40 Minutes 4 Cases - SPEED OF CORRUPTION - 6 Per Hour on a Road near to where i stay. Its Very Visible Now.

Total Corruption Uncovered Under UPA - II only is more than 100000 Billion Dollars within India and Outside by the Entire Indian ministries , Bureaucracy , Departments , Government Officials and Government servants combined . Can someone suggest me if this is the corruption uncovered in UPA -II , what is the estimate of the actual corruption uncovered in UPA & Congress - I i.e for the last 60-65 Years of Country rule by them. For Ex. some of the Cabinet Ministers who are retired from the previous Congress central Ministries have known to amass more than 10 Billion Dollars worth of Total asses during their government service i.e without the government pay is what we have calculated . Most of their assets are also located outside the country in form of Boulevards , Bungalows , Hectares of Farm land , Buildings and other Businesses ( which are converted to white money this way ) in other countries also . Can someone suggest me how to make the Judiciary accountable to catch these corrupt bastards , punish them and also Bring/Take back all the country's money back from them . Do we have a Judiciary accountable and uncorrupt itself and also actionable enough to make this happen . if it happens in even a most of the cases, there will be an example set and India can gain back lot of its wealth which is unseen to the normal countrymen & women . May god be with us .

ONSTITUENT ASSEMBLY OF INDIA DEBATES (PROCEEDINGS) - VOLUME XI Saturday, the 19th November 1949 - The Constituent Assembly of India met in the Constitution Hall, New Delhi at Ten of the Clock, Mr. President (The Honourable Dr. Rajendra Prasad) in the Chair. Seth Damodar Swarup (United Provinces: General): *[Mr. President, the Second Reading of the Drift Constitution has ended and the Third Reading is going on which will also conclude in three or four days. After that the inauguration of this Constitution will be held over till the historic day of the 26th January. All this is good and for that the Honourable Dr. Ambedkar and his other colleagues of the Drafting Committee deserve the congratulations of the whole House, because they have drafted this Constitution with great skin and labour. Sir, ordinarily it would be expected of me who is a Member of this House that I should have a feeling of satisfaction for the successful completion of our labours. But Sir, permit me to say that at this moment when I am speaking on this Constitution in this House, far from having any sense of satisfaction I am feeling extremely depressed. The fact is that it appears to me as if my heart were sinking at this moment and a slow palsy is overtaking me. This is due to my realisation that in spite of the fact that the British rule ended more than two years ago, the misfortune of the country and its people is that they have not yet perceived in the least any improvement in their conditions as a result of this change. I am afraid that the masses instead of finding any improvement in their lot are beginning to suspect that their lot is becoming worse as a result of this political change. They are unable to perceive as to where all this will end. The fact is that the general public, in whose name this Constitution has been framed and would be passed, sees only despair and darkness around them. Mr. President, some of our friends thought that so far no change has been apparent in the condition of the general masses, because so far the Constitution and the laws framed by the British Government are in force. They believed that when our Indian constitution is ready, the masses would definitely feel that they are on the way to progress. But, Mr. President, I wish to be excused for placing the hard reality before you. The people of this country would not at all be satisfied or happy even after this Constitution is completed and enforced. Because what is there for them, in this Constitution, as it has evolved now, and is soon going to be enforced? You may go through it from the beginning to the end, you will not find anywhere in it any provision for bread for the poor, starving, naked and oppressed people of India. What attempt has been made in this constitution for solving their day to day problems ? Besides this, it does not contain any guarantee of work, or employment for them. Far from ensuring to them wages according to their work, there is no guarantee in it even for a living wage even for a minimum wage and payment for subsistence. In these circumstances, Mr. President, even though this Constitution may be the biggest and bulkiest constitution in the world, may even be the most detailed one, it may be heaven for the lawyers, and may even be the Magna Charta for the capitalists of India, but so far as the poor and the tens of millions of toiling,, starving and naked masses of India are concerned, there is nothing in it for them. For them it is a bulky volume, nothing more than waste paper. It is a different matter whether we accept this fact Or not, but we would have to admit that even if we ignore the views of the public, we would have to pay attention to the opinion of the great people. I wish to invite your attention to the opinion of the honourable the Speaker of our Indian Parliament. He says that constitution that has been framed does not at all contain any shade of Indian genius, and is quite contrary to that. If I am not mistaken the General Secretary of the Congress, Shri Shankarrao Deo has also expressed his views about this Constitution in this House. He says that this Constitution is bound to be rejected if a referendum is taken. So even he leaving aside the views of the general public about this Constitution and only taking into consideration the views of such respectable people how can we claim, that the public will be satisfied with it? Mr. President the reason is clear. This Constitution has been framed by the people who are not the true representatives of the general masses. I have stated previously that the framers of this Constitution at best represent 14 per cent. of the Indian masses. This is a bitter fact. We, who are here in this House as the representatives of the public have failed to fulfill our duty for which we had assembled here due to various reasons and causes such as party politics. It is for this reason that the people of India are particularly faced with disappointment again, as they had seen after the change of Government. Then, we have to consider, what is in store for us? There is no doubt that the Indian masses will never accept this Constitution in the words of respected Shri Shankarrao Deo. This Constitution cannot work permanently in this country. We have seen that there are some good things too in this Constitution and some nice principles have been enunciated in this, e.g. there is a mention of general franchise and joint electorate, abolition of untouchability. But so far as the principles are concerned, they may be, quite all right. But how far they would be enforced in practice, will be seen when they are put into practice. We see that the mention of Fundamental Rights in the Constitution is a significant matter. But Mr. President, have we really got some Fundamental Rights through this Constitution? I can say emphatically that the grant of Fundamental Rights is a mere farce. They have been given by one hand and taken away by the other. We have been told in plain words that this guarantee about the fundamental rights will not apply in the case of the Acts at present in force, and in respect of libel slander, or contempt of court and the Government is authorised to enact such laws even in future. Besides this, so far as the right of association or the right to go from one place to another is concerned, the Government will have the right to enact any law to take away these rights in the name of public interest so the grant of Fundamental Rights is a farce. Then, Mr. President, we see that the law regarding property is identical with that contained in the Government of India Act of 1935. The result would be that it would be impossible to nationalise property and there would be many obstacles in effecting such economic reforms as may be in the interest of the public. Mr. President, it is a matter of surprise, of pain indeed, that while speaking on the Objective Resolution our Prime Minister had said emphatically that he was a socialist. He had also expressed the hope that the Constitution would be of a socialist republic. We listened to all his speech, but when the amendment seeking to add the word 'socialist' with the word 'republic' was moved in the House, it was rejected. Mr. President, on the one hand we desire that today's social structure should be maintained without any alteration, and on the other hand we also wish that poverty and unemployment should vanish from this country. Both these things cannot go hand in hand. While in America our Prime Minister said that socialism and capitalism cannot go hand in hand; it is surprising as to how it can be expected to maintain status quo, to maintain capitalism and also to remove the poverty and unemployment of the masses. Both these things are quite incompatible. It is felt therefore that starving, naked and oppressed people of India would perhaps continue to be in the same misery as they are today. Besides this even viewing this from other points of view too we do not arrive at any happy conclusion. Nowadays there is a lot of talk about co-operative commonwealth in our country. But what is the actual fact? It is no direction to say in the Directive Principles that the Governments would establish any such thing. To give directives in round about words is different from giving clear directive for establishing such a order. Still the Congress President wants us to cherish the hope that a classless society will be established in this country within five years. A layman like me is however unable to understand as to how to reconcile the two statements, the one that we hate socialism and want to maintain the status quo the other that we wish to establish a classless society in our country while preserving the exploiting group. I cannot see how these two objects which are mutually opposite can be realised. Besides this there are several minor things which could be accomplished but have not been done. The demand for the separation of the executive and the judiciary is a very old one-perhaps as old as the Indian National Congress is believed to be. But this Constitution does not contain any definite plan, any adequate provision to separate the executive and the judiciary as soon as possible. Looking at States, I can say that no decision has yet been taken to end the Jagirdari system. The result would be that millions of peasants of the States would continue to be slaves of the Jagirdars. Besides this, the farm labourers would continue to be the slaves of the money lenders. Along with this we see that this Constitution contains so many things which are far more reactionary and backward than the provisions of the Government of India Act of 1935. It was provided in the first draft of this Constitution that the Governor would be elected direct by the voters. Later on another proposal was made saying that the Government would be appointed by a panel. But now the President has been given the right to select the Govern

After 9 days of fasting and waiting for some response from the government, the Anna team gave up on the government. The 2 old anti-corruption movement is at the cross roads. It can die a natural death like many other movements in the past. The stakes are too high for both the warring parties. The future of India and its citizens are at stake. Something drastically different needs to be done. Protests, indefinite fasts is not going to work. It is time to catch the bull by its horns. The Anna team is seriously thinking of presenting some form of political alternative to the people. The structure and the format of this and whether it works will become clear as the time goes by. During the entire period of this revolution, parliamentarians have argued that they are elected representatives. Technically they are right and unfortunately that is where it ends. Democracy is about majority rule. This is hardly the case in India. Only 50 to 60% people vote because the remaining have given up on the political system. The ruling group is formed by collection of parties, none of whom gets more than 25% of the votes. Clearly, people have rejected one and all including those who are 'elected' and those who form the government. People who are rejected by people become the rulers by cobling up unholy alliance to "share the power" for their mutual gains. The voters and their views are ignored or completely rejected and the spirit of democracy takes a hit. In India, the elections is not about political parties presenting to people their past track record or future agenda. Instead, elections are purely based on emotional issues or vote banks. Each party, small or big survives and wins elections based on religion, caste, region etc. The past track record and future agenda is given go by. Let us be clear, this vote bank politics is nothing but divide and rule politics in its worse form. This allows every small political group to create a vote bank of his own, win a small number of votes and seats and then become part of the ruling coalition so that everyone gets a chance to exploit the system and the people. As a result, a corrupt and poor performer gets re-elected whereas an honest and good performer gets rejected. Citizens have paid heavy price of this in form of Communal riots, High inflation, High poverty, High taxes, poor development. As a result of this arrangement the political class thrives at the cost of citizens. These two anamolies have ruined the indian democracy in its spirit. The entire political system is nothing but some kind of arrangement between the political class that "you scratch my back and I scratch my back". The ruling class that emerge out of this system becomes master of the people. Different parties gets their chance and their share to exploit the system and the people by turn. The indian democracy is not "for the people, by the people, from the people". Instead, it is "by the politicians, by the politicians, from the politicians". Large number of articles are written exposing the exploitation. Media also comes out with expose at regular frequency. The citizens have developed hatred with the political class. Movies such as Inquilab, Rang de Basanti, Apna Desh, Aaj ka MLA Ram Avtar presents exploited citizens as heroes who take the law in their hands and takes revenge from the politicians who are shown as villians. Clearly, politicians do not carry good image amongs the masses. 64 years after 1947 have hardly been remarkable. If this kind of performance had been given by any form of government, it would have been overthrown long back, be it monarchy, army rule, foreign rule or whatever. Still, the political class is able to continue to rule over the masses by showing the "democracy" card and telling that they have been elected by the people. Audience claps and the movie becomes a hit only when the hero kills several politicians. Time has come to tell them that they have been rejected repeatedly in the past and not selected repeatedly. Team Anna have been carrying out anti-corruption campaign for more than 2 years. It started small. They met all political parties, formed joint committees, discussed all options while being firm on a strong lokpal bill. Even though the government talked to them, they were clearly not willing to go too far to address Team Anna's point of view to their satisfaction. After all the entire political system is corrupt and strong lokpal will only fix the system by fixing the corrupt politicians who are ministers in the government and are the law makers. When faced with opposition from the government, Anna sat on indefinite fast in Aug 2011. Unwillingly, the govt was forced to give assurance to meet anna demands only after 12 days of fasting that was too insensitive. In spite of assurance, nothing happened forcing yet another fast not only by Anna but more than 300 people. This time, the government simply ignored them and allowed their health to deteriorate and risk their lives. Having strong anti-corruption bill was too much of a price to pay. Letting these people die is much easy for this insensitive government. Rather than listening to the genuine voice of the people, they have repeatedly challenged Anna and team to fight elections and only then get their way. Such a response has serious implications as it is clear that the government is not going to heed to any non-political pressure groups. If a person wants to file FIR or ask for some justice, does he have to float a political party, win election and only get justice. This is the message that this un-responsive government has given to the public. Team Anna will do well to understand that it is up against tyrannical rulers,who subject millions of Indians to abject poverty year after year and decade after decade by siphoning off public money and making a farce of governance and development. My personal belief is that this second fast could have been totally avoided. If you have to win over your adversary, you need to catch them surprise by different strategies each time. The second fast was nothing but a repetition of the earlier fast. The surprise element was missing. So, the government simply looked the other way. So, where does this movement go. Will it take a natural death. People have poor memory. This movement will be forgotten sooner or later. Will we be condemned to be continued to be ruled by inefficient and corrupt government for the times to come. Will nobody raise voice against corruption again in India. Will the political class return to their comfortable ways. Will the masses keep getting exploited by them endlessly. Well, this is a distinct possibility. Gandhi revolution failed. JP revolution failed. It is very much possible that Anna movement will also fade away sooner or later. The stakes are too high. The only option left is to deal with the political class with the language that they understand. Anna has talked about some form of political alternative. Whatever may be the format of political alternative, Anna will be good to recognize the following huge challenges: 1. Very small organization compared to full fledged organization of the present political parties. 2. Lack of funds. 3. Committed Vote banks 4. Politics of coalition where the loosers first form a group and then form the government. Will the clean Anna team be ready to team up with corrupt political teams The current political system is seasoned in the above. The above challenges presents a major entry barrier to any new political unit. Will Anna be able to go past these challenges. What will be the format of this political alternative. Only time will tell how Anna team will handle these challenges in the times to come. A strong lokpal bill may not solve all the problems. But it will act as a huge deterrant to corruption, just like having a nuclear bomb is a big deterrent to hostile neighbors. With corruption under control it can transform the political system and governance in India in a significant way. Many countries have strong anti corruption bill for a long period now. Amongst several places dug up in Mumbai, the Municipal Corporation (MMC) has recently started activity of laying pipelines at the access road to two residential colonies of Chembur, Dongre Park & Raj Kunj Society. This road, which flanks St. Sebastian School and Loreto Convent School is frequented mainly by children and now has ditches approximately 7 feet in depth, 4 feet in width and 100 "grave" yards in length. This road is the singular road that connects the residents with the outside world. The contractor has conveniently ignored his responsibility of providing a safe and temporary access road to the residents. For those who believe that the nuisance of MMC is through the roof, it is not the end of the story. Huge trucks use this road throughout the day to fill water in their tankers. As a result, a width of about 6 ft is available for cars to barely squeeze in through the gaps. Oblivious children are primarily affected by this menace. This nuisance is a threat to the safety of the residents. Time and again MMC has denigrated its credentials through poor planning, pitiable execution and earned the reputation of Mumbai Menace Corporation. Is the future of Mumbai in good hands?

Indian masses are neither democratic nor superior enough to enjoy democracy. Indian politicians, police officers, judges, bureaucrats are in general corrupt of worse kind but even then there are few who now and then stand like rock against corruption, but Indian masses are the weakest link, they keep on sending even convicted hard-core criminals back to parliament for their narrow interests. The basic law of nature is that every living entity gets what he/she desires, that is why humans have brain, snakes have poison and birds have wings. Despite of all hue and cry, Indian masses DO NOT genuinely desire a fair society. The day they desire it genuinely, they will get it next day. Indians are getting exactly what they deserve.

The past 7 to 10 years our country is going down in all way it can. The government is doing all it can to show that the ship is not sinking but we all the fact. Congress party which much to our knowledge has been lead by great leaders is sadly the very reason. I used to reason on how great leader in several parties specially congress become so arr-agent when it comes to subject of corruption. I could think of only one reason. I don't understand how can Sonia who does not know anything about this country become a prominent leader. She has come from a widow to one of the most powerful person in India. Certainly money plays a great role. But I am really feeling it hard to believe that she is running our country. She is the very reason a party like congress had lost its credibility. Once a great party with eminent leaders are now what can we say. I don't believe in bringing another Lokpal. I believe that the judiciary must be made more powerful with more effective and strict rules. Corruption should be viewed as a hideous crime as rape, murder or assault. The people who commit it should be considered outlaws, keep outside of the community. I am not a person who live in hatred. But this country has reached this stage because of the corrupt politicians and bureaucrats who instead of helping the poor and helpless are rather greedy wolves who tear their flesh and steal them of their earning of hard work. Shame on all of us, we believe that unless we are haunted we are safe. This very belief has unleashed this ghost called corruption and it has grown so powerful a force that it is capable of protecting its existence. With politicians and bureaucrats having their black money stuffed in the foreign bank fight to keep the corruption than eradicate it and we happily think its a drama while we are the people who are being fooled. Anna for one reason must be supported because he is fighting for a good cause. I hope my country will be a better place for my kids. Jai Hind.

Dear Sir, I & my wife are Senior Citizens and we were covered by mediclaim policy for 7 yrs. In May 2007 my wife was detected with Cancer and with great difficulty we could get some claims. The policy was renewed for two years. In Jan 2011 the new branch manager refused to renew for 2011. Unfortunately my wife passed away in june 2011 and there was no need for any more policy. However, it gives me great pain to inform you that the branch manager was very insulting and has no respect for customers or senior citizens or cancer patients. He said that people like us are making the insurance company loss making and he will not renew our policies.. In Nov 2009 I was also detected with cancer. However, the same branch manager refused to renew my policy also and now i am un insured.since JANUARY 2011. The Branch manager went a step further and even threatened my agent who is an agent for 40 years for various insurance companies that he will cancel his agency if the agent contacted his office for the same. This is the technique he using for taking bribes and we refuse to give it. His name is Mr *******, Nagpur Branch, ******* ******* Insurance Co. Respected Sir, may i request you to please pursue this matter and ensure that such managers are brought to the task and would you please help me to have my policy renewed. Our governance structures are quite dismal in our enforcement of law and order, in our economic regulatory framework, in civil administration. This is behind our weak implementation of well-intentioned laws, our infrastructural deficit. Our civil administration is organized in a way that is not performance-based. Governance problems are compounded by the ease of collusion of vested interests. Governance at all levels is bound to be weak when social actors have a rather relaxed attitude to law-breaking as in India. Good governance has 8 major characteristics. It is participatory, consensus oriented, accountable, transparent, responsive, effective and efficient, equitable and inclusive and follows the rule of law. It assures that corruption is minimized, the views of minorities are taken into account and that the voices of the most vulnerable in society are heard in decision-making. It is also responsive to the present and future needs of society.

The Administration in corruption still gradually day by day and the entire I.I.Tians/ Employee are watching and understand the whole process on deaf and dump. In last Eight years, I have seen which I have not seen before? I found scene the fear able faces of either Prof. or students a unforeseen lines of their faces always, which drastically hamper their working style, who is not knowledgeable but backbone of future of our country. The knowledgeable professor/ students/administrator are forcibly set-aside. A person not know the administration rules, conducts etc. simply by a upper division clerk run the entire I.I.T.K. in the shadow of our Hon'ble *******. I became stund and curious to knowing the original picture behind the original facts. The actual facts which was run in a very planned way was simply 'corruption' and hidden the other unparliamently way by our Hon'ble ***** '*******' (Legal Cell) of mercy hand of our Hon'ble ****** Sri ******. During the course of investigation I found the misuse of National money/property in Hitlersahi way (andaj) more than 500 crores in past Eight years. Even though they do not hesitate to violate the prescribed process, norms of Administration, for exemplary account one, which is completely under control by Govt. of India. Accounts two and Projects Accounts is not highlighted and in future the bundles of scandals will be opened. In this context, I have served a legal notice to Chief Secretary, M.H.R.D. which is annexed herewith, in which the entire stories can easily readout. Importantly, I pin down with tear eyes that the brilliant students belongs to middle class family are maximum harass and mentally and financially way to inspire and put the position for suicide in last three years. To, Mr. ******** *******, Chairperson, Jharkhand Electricity Regulatory Commission, Mr. ****** ******, Secretary Jharkhand Electricity Regulatory Commission Sirs, Do you know "JSEB has not been able to reduce the losses over the years and is running into losses due to their own poor performance wherein 40- 50% of electricity remains unaccounted for due to poor supply system or theft of electricity. Only if the losses are reduced, then there would not be any need of tariff hike and the consumers should not be burdened due to the inefficiencies of the Petitioner." Does this 50% unaccounted electricity, worth of about 2000 crores (about a half billion USD) every year, go into the pocket of officials of JSEB? How much JSEB officials pocket bribe in order to patronize electricity theft, though theft may be just a small part of the total unaccounted electricity? According to approved domestic tariff for FY 2011-12 for DS-I (a), Kutir Jyoti (metered) (0-100 units), if a electricity stealer uses about 10 CFL bulbs for the whole night, subject to the limited hours of supply, his/her bill will come less than Rs. 50 a month (fixed charge Rs. 12, per unit Rs. 1.10). Don't JSEB officials extort bribe of more than Rs. 50 a WEEK from thousands of electricity stealers exploiting their ignorance and by threatening them? Can anyone file a Public Interest Litigation (PIL) against this ongoing scam of 2000 crores every year? The annual current employee cost of JSEB is about 300 crores. Is there a single effective approachable employee dedicated for its millions of customers for their grievances? Does JSEB have a single email id of any officer publicly available? When JSEB has no effective grievance redressal mechanism, does it mean JSEB itself patronizes corruption? My experience with Jharkhand State Electricity department: To, Mr. ******* ******, Chairperson, Jharkhand Electricity Regulatory Commission, Mr. **** ********, Secretary Jharkhand Electricity Regulatory Commission Sir, I would like to draw your attention towards the flawed and outrageous electricity bill sent to us and towards pathetic way of functioning of a Jharkhand State Electricity department office. We used to receive electricity bill of Rs. 1000 around per month. Suddenly we have received a bill of Rs. 8000 for last month's electricity consumption (electric supply: few hours a day). This happened after a team of electricity officials came to us and informed us that our meter is not functioning properly. Our meter was replaced by the electricity department just six months ago on our application and request, The meter was supplied by the department too. We have not even touched the meter after their installation. The electric official then noted down all the electric appliances at our place, including 7 CFL bulbs (~15 watt each), 30 ordinary bulbs (100 watt each), and thus totaling 5000 watt (5KW). Please note that where we frequently use our bulbs, we have CFL bulbs. And now a bill has been sent on a lump sum basis for 5KW consumption, which is mainly meant for industrial connections. When electricity department had visited our place and had calculated this way 5KW, we had doubt that they may send irrational bill. So keeping this in mind we immediately went to the electricity department and submitted an application to replace our meter, whose acknowledgment we have with us, without waiting for the next electricity bill. However the meter is not replaced yet but outrageous bill has indeed arrived to us. When we visited to the concerned executive engineer, he justifies his department's bill. He is also insisting that we should take a 3 phase connection. What we are saying is that if our meter is not functioning well, either take bill averaged over the previous bills or install a new meter today and take a average bill coming from the future use. Also my questions are - 1. we have been given a 5KW bill. By having thirty 100 watt ordinary bulbs, are we running a industry, that we have been supplied a 5KW bill meant for the industries? 2. By just having bulbs, does it mean there are no off-on switch attached to them and they are in use all the day and night? Is it not insane to render a bill to a customer based on installed bulbs when a consumer is ready and making rounds to the concerned office to get a meter installed? 3. Why we should be forced to pay outrageous bill on your lump sum calculation when we are ready to pay on actual consumption. 4. Do we need a 3 phase (normally needed for running big machines, welding machines etc.) connection for CFL bulbs? 5. The whole incident's bribe extortion aspect may follow up in the next emails. Could you please look into this matter? The concerned electricity office is Garhwa, Jharkhand. PS: 1. But in the course of this journey we have ignored one thing that in order to fight against all the odds we are drawing near to the cause of the end of this world i.e. CORRUPTION. Exactly our nation THE GREAT INDIA still wants to proceed in a good pathway, but we, its people, THE INDIANS, are in such a hurry that we can’t even wait patiently for our turns to come, which can be exemplified in a very perfect manner by the following incident. “ My friend is working in one of the renowned and reputed MNC company situated in Bangalore. One month ago she was in desperate need of a rented house. After a long and tiring search she got a house in White Fields area which is very near to her office. The landlord took her in his confidence and made her to pay Rs. 25000 cash, she first offered the cheque but he refused to accept, so in that case she has to pay the hard cash. But due to some reason she couldn’t able to shift to the house and decided to be there where she is residing presently. In that course she went back to the landlord and asked for the money, he assured her that whenever he will get a new tenant he will give the money back, but it never happened. When after a month she called him back, he refused to give the money. She tried her level best. Later she came to know that the landlord is actually been suspended from his duty in 2004 in charge of corruption. But now he is roaming free and cheating people. My friend is in great depression of not only losing the money but also the trust as the transaction so happened never been documented and she has no eyewitness to prove.” India is a land of oath and promises but we have to really think 100 times to trust our own people. We make our nation, we are its future but now our future is at stake. A badly laid 4 km stretch road in a metro city on which thousands of car ply in a day. It takes 30 to 45 minutes to cover that 4 km distance in a Car.Then we can imagine the kind of Man hours wasted by Indians. The amount of petrol wasted in India.For example a car which can give 15 kms/L, ends up giving 8 kms/L. Then 467 milli litres is wasted by a Car/L X 2000 Cars/day.(a humble figure).Then we end up wasting 934 L/DAY. X no.of similar roads in India. say 500 roads(humble figure). That means 934x500= 4,67,000 L/DAY India Can waste. Amounts to Rs.2,80,20,000/day. When whole world is craving for future energy resource, we in India are sitting on a Energy time bomb which will deplete/destroy energy sources. It's high time we Indians start thinking what we are going to leave for our Grand Children ? Are they going to walk,when we drive in imported Cars.A selfish politician loots 40% of money alloted for laying the road. Similarly, so many crores of rupees are looted throughout India. Congratulations to whole nation for victory on anna issue. While working in the academic field i have felt that many of faculty post remains vacant. Government always shows data that so much vacancy is there and number of faculties are required but they advertise very less frequently and takes limited number of faculty saying they didn't find suitable candidate. Then what they do to fill up those positions. It remains vacant. And where these funds (that should be otherwise given to faculties) goes in meantime. These are the government policies to make fool general public. I suggest to make a survey in this issue.

If we 1.21 billion people are not able elect one man the Prime Minister on whom we can believe for 5 years. If our system is not able to select the one honest CJI then where is the guarantee that we will be able to select an honest lokpal? ->And if we can choose one honest lokpal then why can’t we apply the same procedure for the CJI? Where will this chain stop? Will people to man Lokpal Committee and their staff come from mars? And what if they fail then? I can remember an instance in the RTO office where I had gone to get my license. The guy responsible was working efficiently enough then a middle aged man walked in and demanded for his license. The officer asked him to get his medical certificate don as he was more than 50 years of age. That man started to nag him asking him to do his job. The RTO refused a couple of times and then he got irritated and chided the commoner. And I am quite sure that when that man walked out of the office and complained that his job was not done coz he did not pay money! The Annas and the Ramdevs of today who are trying to instigate a revolt against corruption are correct in their agenda. But we live in a country where the general folk are ready to pay money to get the job done. The correct way is always more tedious and time taking. And all of us want an easy way out of our troubles. We Indians live in the largest democratic setup in the world. And I individually am proud of it. Whatever be said and done India is developing at the rate of knots. Which means our government is doing a fair job. Our system says that people get the type of government they support. But is the public who are not able to choose the correct person to govern them. Thus I am aggrieved on a few of the following counts. Majority of our people have double standards. Most of us become happy in getting things out of turn. And most of us also get it! As I quoted in the beginning of the composition that the RTO did not ask for bribe! I have never seen a ticket checker following passengers to give tickets in the train. But the scenes are usually the other way round. When we vote to elect our representative we do not use the best available candidate but generally we have our preowned notions of caste creed and acquaintance. A democracy is run by the common folk not by extraordinaire. The genius or the extraordinaire have only right that, they may try to convince people by campaigning about their ideas how good result will be brought in their life etc. And by making people realise their future under their leaders. And many greats have done marvelous jobs! In this regard in past I have never seen any of them use violent or for that matter non violent means of force. I have seen them believing in themselves and in their ideas and goodness in the common sense of people. I agree on how Hon Hazare and Kejrival are aggrieved with the current status of corruption and functioning of administration and government. But I wish that they should try to convince people and put democratic pressure on the government to amend their policies against corruption. I am absolutely against their tactics. I feel if they have faith in their ideas and common sense then hwy must organise awareness campaigns rather than hunger strikes! I have the following questions for them -> If we 121 crore people are not able elect one man the Prime Minister on whom we can believe for 5 years. If our system is not able to select one honest CJI then where is the guarantee that we will be able to select an honest lokpal? And if we can’t select one honest CJI where is the guarantee now that we will be able to select honest lot of machinery for enquiry deeds of 1.2 crore employees. Will they come from Mars??? We are demanding from the Parliament and politicians and condemning the day in day out. Isn’t this hilariously contradictory? If it’s our belief is that all politicians are corrupt and we are living in a democracy then blame also lies also on us including Hazare and his company! It is our job to choose the correct non corrupt politicians to replace the corrupt ones. It is we the people of India who have to amend our social and political system.

The clerks do not pass their documents to get JRF Certificate and scholarships unitll the student pays bribe to them. If you do not pay, they will hide your file and ask to send the documents again and again throwing your scholarship process into never ending deadlock. We have creek near my home called as Kolshet, Thane (w) - 400 607. It is located about 200m from residential area, and people come there for roaming and as it is good place like seashore. Some local people come there for drink also. Today we (me and my friend (he))had gone for roaming and just we were talking where, 2 policemen caught us, saying you should not be here, it is restricted area at night. But actually nowhere it is mentioned and many people come here everyday. Then he took my license and told us to come to police station and he will report a case on us against vehicle act something 126. and we will have to pay rs. 2000. and taken my license. Then on the way he started frightening us, and told us to give them bribe, when i offered 100rs. he was unhappy and asked my friend to give more 100rs. This type of cases are happening frequently. My views are -- 1-Only CJ of supreme court should be kept out of Lokpal ambit. 2- To have a check on Lokpal, there should be committee under CJ of SC which should be empowered to deal corruption against him. Under current system of elections it is quite possibility that only anti social elements reach Loksabha/assembly on the basis of muscle and money power. Until , unless election system is reformed , it is quite doubtful that an effective Lokpal bill will be enacted because no so-called public representative will be willing to get it through as their vested interest will be involved in doing so.It may be possibility that govt. will crush this movement. No doubt Anna Hazare is fighting for right cause. And one day he will succeed. In my opinion Govt. will not allow Hazare to fast at Jantar Mantar.

Whistleblowers be protected .Info given by them should be authenticated by an independent private organisation before maligning someone.The independent private org should include eminent persons from all walks of life with a reputation of honesty and integrity.

We have known of corruption in judiaciary but we cannot do anything. It is highly risky for anyone to raise a finger against any acting judge of High Court or Supreme Court. So we need to wait till the judge retires. I learnt from my negotiations with various lawyers that there is new word named "equation". Justice is gradually becoming taken over by "equation". It is for the litigitant to find out the right link, pay the cost and get the order. Law is on book only. Judges have wide discretionary power under the law. Now the choice. Going though "equation" channel the cost is hefty and only rich can afford. So rich people have easy justice. We have known from reports that maximum judgements are in favour of rich people only and this can explain "equation". Only few poor gets the justice so that milk donot over spill. Much is said that relative lawer of a judge cannot plead before the said judge. But it is not the truth. The lawyer can plead before the judge untill any protest lodged. But who will bell the cat? Bar knows the difficulty in removing an acting judge specially when the judge is from High Court or Supreme Court. Now, everyone has to earn the bread. Better keep silent and let things go is the general trend. The untimate sufferer is the justice. Poor people are just helpless. We have to consign to our fate. It is God that made us poor and wanted us to suffer so let us accept the truth.
